За європейською хартією місцевого самоврядування “право громадян брати участь в управлінні державними справами належить до загальних для всіх держав-членів Ради Європи демократичних принципів ”.
Європейська хартія про участь молоді в муніципальному та регіональному житті (закріплені принципи, що спрямовані на залучення молоді до процесу прийняття рішень, які безпосередньо впливають на їхнє життя).
Конституція України також визначає місцеве самоврядування, як право територіальних громад, тобто жителів відповідних територій в управлінні державними справами (ст.140, частина 1).
Право громадян на участь у місцевому самоврядуванні за належністю до відповідних територіальних громад (обумовлене окремою ст.3 закону України “Про місцеве самоврядування в Україні»).
Орган самоорганізації населення є однією з форм участі членів територіальних громад сіл, селищ, міст, районів у містах у вирішенні окремих питань місцевого значення (ст.3 закон України “Про органи самоорганізації населення. ”)
За законом “Про столицю України – місто-герой Київ”
(ст.7) система місцевого самоврядування у місті Києві включає:

  • територіальну громаду міста
  • міського голову
  • міську раду
  • виконавчий орган міської ради
  • районні ради
  • органи самоорганізації населення
